Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Hymods ("Hymods", "we", "us", or "our") and our website, apps, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

1. The Service

Hymods is a marketplace and distribution platform for mods and related digital content (the "Content"), including both free and paid items. Certain features may be subject to additional guidelines or policies, which are incorporated into these Terms by reference.

The Service may also support collections of Content (for example, modpacks) and creator collaboration features (such as shared listing management).

2. Accounts

• Eligibility: You must be able to form a binding contract in your jurisdiction to use the Service.
• Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Accurate information: You agree to provide accurate information and keep it up to date.

3. Marketplace, purchases, and payments

Payments (Stripe)

Payments are processed by third-party payment processors such as Stripe. By making a purchase, you agree to Stripe’s terms and policies as applicable. We do not store your full payment card number.

Digital goods

Items sold on Hymods are digital goods. Access to paid Content may depend on successful payment completion and our fraud/abuse controls.

Paid download fingerprinting

To help deter unauthorized redistribution of paid digital goods, we may embed a digital fingerprint into certain paid downloads (for example, by injecting a signed token into a mod JAR). This fingerprint may identify the purchaser and the specific content version. You agree not to remove, alter, obscure, or attempt to bypass these measures.

Refunds

Unless otherwise required by law or expressly stated by Hymods in writing, purchases are final and non-refundable. If you believe there was an error with a purchase, contact us at hello@hymods.io.

Creators and payouts

Creators may be able to sell Content and receive payouts. Payouts may require onboarding with Stripe (for example, Stripe Connect) and may be subject to verification, delays, reserves, chargebacks, refunds (if applicable), and compliance requirements.

Platform fees

Hymods charges a platform fee on each transaction. For each transaction, the fixed payment processing fee (currently $0.30) is split proportionally among all sellers included in the transaction. After the fixed fee is deducted, Hymods retains a 10% platform fee from each seller's portion of the transaction. The remaining amount is credited to the seller's account for payout.

Example: If a buyer purchases a single item for $10.00, the $0.30 fixed fee is deducted first ($9.70 remaining). Hymods then retains 10% of that amount ($0.97), leaving the creator with $8.73.

4. User content and licenses

You retain ownership of Content you upload, subject to the licenses you grant under these Terms and any third-party rights.

• License to operate the Service: You grant Hymods a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, display, and make your Content available as necessary to operate, improve, and promote the Service.
• Creator-to-user license: If you offer Content to users (free or paid), you grant those users the rights needed to download and use that Content for its intended purpose, subject to any license terms you provide with the Content and applicable law.

You represent and warrant that you have all rights needed to upload and distribute your Content, and that your Content does not include malware or harmful code and does not violate third-party rights (including intellectual property, privacy, and publicity rights).

5. Prohibited conduct

You agree not to:

• Upload Content that infringes intellectual property or privacy rights, or that you do not have the right to distribute.
• Upload malware, harmful code, or attempt to interfere with or disrupt the Service.
• Attempt to bypass access controls, payment gates, or other restrictions.
• Redistribute paid Content without permission, or share, sell, or publish access to paid downloads outside the Service.
• Engage in fraud, chargeback abuse, or other deceptive practices.
• Use the Service in a way that violates applicable laws or regulations.

6. Enforcement and termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, if required by law, or to protect the Service and users. We may also remove or restrict Content at our discretion.

7. Intellectual property

The Service (excluding user Content) is owned by Hymods and its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as permitted by these Terms.

8. Disclaimers

The Service and Content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Hymods will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

10. Changes to these Terms

We may update these Terms from time to time. We will update the effective date above and may provide additional notice for material changes. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
